TL;DR (CB-1)

TL;DR (CB-1)

This is a quick-answer FAQ covering the regulatory shift (May 2026 enforcement), product chemistry (THCA, Δ8, Δ9, HHC, THCP), licensed dispensary basics (ID, COA, payment), and where to buy lab-tested licensed cannabis in Sparks. For deeper detail follow the linked pillar pages.

02 · The regulatory shift

The regulatory shift

### Why did smoke shops in Sparks stop selling THCA flower?

Nevada CCB enforces a "Total THC" standard (Total THC = Δ9-THC + THCA × 0.877) that captures convertible cannabinoids. THCA hemp flower exceeds the Total THC threshold and is cannabis under NRS 678; only NV-CCB-licensed retailers can legally sell it. See the May 2026 transition explainer.

### Did smoke shops break the law before 2026?

Most operated under the 2018 federal Farm Bill hemp framework. Nevada's stricter Total THC math is a state-level enforcement tool that aligns the regulatory line with consumer-protection priorities. The 2026 actions reflect a clearer regulatory line, not necessarily wrongdoing in prior years.

### Will smoke shops come back to selling hemp flower?

It depends on federal Farm Bill 2.0 and on how Nevada CCB enforcement evolves. NV-CCB-licensed dispensaries continue to operate under state cannabis law and carry the only legally licensed cannabis in Nevada.

### What about Δ8, HHC, and THCP?

Smoke-shop Δ8, HHC, and THCP products that exceed Total THC compliance are cannabis under Nevada law and require NV-CCB licensing. See the Delta family explainer.

Product chemistry

### What is THCA?

THCA (tetrahydrocannabinolic acid) is the acidic precursor to Δ9-THC found in raw cannabis. It decarboxylates to Δ9-THC during heating at a 0.877 mass conversion ratio. See THCA vs THC.

### What is Total THC?

Total THC = Δ9-THC + (THCA × 0.877). It's the regulatory math Nevada uses to determine whether a product is hemp or cannabis. See the Total THC standard.

### Is Δ8 the same as Δ9?

No. Δ8 and Δ9 are isomers (same atoms, different bond position). Δ9 is the naturally dominant intoxicant in cannabis. Δ8 is typically synthesized from CBD using acid catalysts.

### What is HHC?

HHC is hexahydrocannabinol, a hydrogenated form of THC made by chemical hydrogenation. It is not naturally produced in significant amounts.

### What is THCP?

THCP is tetrahydrocannabiphorol, a Δ9-THC homolog with a 7-carbon side chain. Published research (Citti et al., Scientific Reports 2019) reported higher CB1 binding affinity than Δ9-THC.

### What is Δ9 hemp drink?

A drink containing Δ9-THC at 0.3% or less by total weight, qualifying as hemp under federal Farm Bill measurement. Nevada Total THC and serving-size analysis often catches these products as cannabis.

### What ID do I need at a NV-licensed dispensary?

Adults 21+ need a government-issued photo ID: state driver's license, state ID card, U.S. passport, U.S. military ID, or tribal ID. Out-of-state IDs are accepted. Expired IDs are not. NV Medical Marijuana cardholders 18+ bring the card and ID.

### Are out-of-state IDs accepted?

Yes for adult-use 21+. Out-of-state Medical Marijuana cards are accepted under NV reciprocity (we'll verify state and validity).

### Can I pay with a credit card?

Generally no. Federal banking restrictions on Schedule I substances mean dispensaries accept cashless ATM (debit) or cash. ATMs are typically on-site.

### How much can I buy in one visit?

Nevada law caps a single transaction at 2.5 oz (about 70 g) of usable cannabis flower or 0.25 oz (1/4 oz, about 7 g) of concentrate. The limit is per transaction; Nevada does not run a statewide individual adult-use purchase tracker.

### What does "lab-tested" mean?

NV-CCB-licensed cannabis must pass cannabinoid potency, pesticide, heavy metals, microbial, water activity, and (for concentrates) residual solvent panels under NV CCB Reg. 5.040. See lab-tested vs hemp products.

### Can I see the COA on a product before buying?

Yes. Greenleaf budtenders can show the COA for any flower, vape, edible, or concentrate before purchase. We can email a copy if requested.

### Will the dispensary report me to anyone?

No. Cannabis purchase data is recorded in METRC for state regulatory tracking; it is not shared with insurers, employers, banks, or advertisers. METRC access is limited to NV CCB regulators and the licensee.

### What do I do with cannabis after I leave?

Keep cannabis in its original child-resistant packaging. Keep sealed in your car if driving (closed container, not in passenger compartment). Do not consume in public, in vehicles, on federal land, in casinos that prohibit, or in hotel rooms that prohibit. Do not transport across state lines. Do not consume and drive (NRS 484C.110 per-se DUI at 2 ng/mL Δ9-THC blood). Keep out of reach of children and pets. ASPCA Animal Poison Control: 888-426-4435 for cannabis exposure.

### Can I fly with NV cannabis?

No. TSA prohibits cannabis on aircraft. Cannabis cannot leave Nevada by any means.

### What's the per-se DUI rule?

Nevada per-se DUI for cannabis is 2 nanograms per milliliter Δ9-THC in whole blood under NRS 484C.110. Any detectable level above the per-se threshold can be charged as DUI regardless of impairment.

### What if I think I or my pet was over-exposed to cannabis?

For pets, contact ASPCA Animal Poison Control: 888-426-4435 or your veterinarian. For humans, contact Poison Control: 1-800-222-1222 or 911 if symptoms are severe. Cannabis overdose is rarely fatal in adults but can be uncomfortable; in children it can be more serious.
