They were marketed as legal, federally compliant, and intoxicating. Some really were federally compliant under the 2018 Farm Bill; some were on shakier ground; some were chemically converted from CBD in ways that left questions about safety and consistency. Δ9-THC is the primary psychoactive cannabinoid in cannabis. Δ8-THC is an isomer (same atoms, different bond position) that is typically chemically converted from CBD using acid catalysts. HHC is hexahydrocannabinol, a hydrogenated form of THC. THCP is a homolog of Δ9-THC with a longer carbon side chain and reportedly higher CB1 receptor binding affinity. THCO is THC acetate ester. Smoke shops sold these under the 2018 federal Farm Bill hemp framework. Nevada CCB enforcement now treats high-Total-THC products as cannabis under NRS 678, regardless of which isomer or homolog is on the label. NV-CCB-licensed cannabis (the licensed alternative) uses naturally-derived Δ9-THC and THCA from licensed cultivation.
The hemp loophole, one sentence
The 2018 federal Farm Bill defined hemp as cannabis with 0.3% Δ9-THC or less by dry weight; this single-cannabinoid measurement created a window where intoxicating cannabinoids that aren't Δ9-THC (Δ8, HHC, THCP) or that are technically Δ9 but stay under 0.3% by weight (Δ9 hemp drinks, micro-dosed gummies) could be sold by unlicensed retailers under the federal framework.
The cannabinoid family - what each one is

Δ9-THC - the original
Δ9-THC is the cannabinoid most associated with the cannabis "high." It binds the human CB1 receptor and produces psychoactive effects, appetite stimulation, altered perception, and (for some people) anxiety or sleep changes at higher doses. NV-CCB-licensed cannabis flower, vapes, and edibles deliver Δ9-THC from licensed cultivation, decarboxylated from THCA naturally during heating or processing.
Smoke shops sold "Δ9 hemp gummies" and "Δ9 hemp drinks" with very low Δ9 per gram of total weight (technically ≤0.3%) but with enough total Δ9 per package to be functionally intoxicating. Nevada's Total THC framework and serving-size analysis catches many of those products.
Δ8-THC - the isomer
Δ8-THC has the same molecular formula as Δ9-THC but a double bond at the 8th carbon instead of the 9th. It is psychoactive, generally reported as somewhat less potent than Δ9-THC at the same milligram dose. The FDA in 2022 raised concerns about Δ8 products including: (a) reliance on chemical synthesis from CBD using strong acids and solvents that may leave residues; (b) inconsistent labeling and dosing; (c) products marketed in packaging appealing to children. Δ8 was the largest single-cannabinoid category at smoke shops.
HHC - the hydrogenated
HHC is hexahydrocannabinol. The molecule is a hydrogenated form of THC, meaning the double bonds are saturated with hydrogen using a metal catalyst (palladium or platinum). HHC is reported to be intoxicating, with effects somewhat similar to Δ9-THC. Because hydrogenation is an industrial chemical step, HHC products are not produced from licensed cannabis cultivation in the way dispensary cannabis is. The FDA has not approved HHC for any therapeutic use.
THCP - the high-affinity homolog
THCP (tetrahydrocannabiphorol) is structurally Δ9-THC with a 7-carbon side chain instead of Δ9's 5-carbon side chain. Published research (Citti et al., Scientific Reports 2019) reported THCP binds CB1 with substantially higher affinity than Δ9-THC. Smoke shop THCP vape carts marketed this as "stronger than Δ9." Real-world dose translation is complicated, and the products have not been clinically dose-titrated.
THCO - the FDA-flagged
THCO is THC acetate ester, a chemically modified form. The DEA in 2023 sent a letter clarifying that synthetically derived THC analogs are not protected by the Farm Bill hemp framework. Many smoke shops pulled THCO products after that letter. Some continued to carry them.
Δ9 hemp drinks and gummies - the sleeper category
The fastest-growing category of smoke-shop hemp products in 2024-2025 was Δ9 hemp drinks and gummies. The math: a 12-ounce hemp drink (340g) at 0.3% Δ9-THC by dry weight allows up to ~10mg Δ9 per drink while remaining federally hemp by single-cannabinoid measurement. A 5g hemp gummy at 0.3% allows up to 15mg Δ9 per gummy. The drinks and gummies were functionally cannabis edibles sold outside the licensed system. Nevada Total THC math addresses these by serving-size and functional analysis.
Why Nevada now treats these as cannabis (CB-2)
The 2018 federal Farm Bill measures hemp on Δ9-THC alone. Nevada's Total THC formula (Total THC = Δ9-THC + THCA × 0.877) captures convertible cannabinoids that the federal framework does not catch, and Nevada CCB enforcement extends similar logic to Δ8, HHC, THCO, and THCP - products that exceed Total THC compliance and fall under cannabis under NRS 678 require NV-CCB licensing to sell.
What's the licensed alternative?
NV-CCB-licensed cannabis is naturally-derived Δ9-THC (and naturally-occurring minors like CBG, CBN, CBC, THCV, THCA) from licensed cultivation. Lab COAs disclose every cannabinoid measured on a HPLC potency profile. There are no chemical conversions from CBD, no acetate esters, no hydrogenated synthetics in licensed dispensary cannabis. The supply chain is METRC-tracked from seed to sale.

No. Δ8 and Δ9 are isomers - same atoms, different bond position. Δ9 is the naturally dominant intoxicant. Δ8 is typically synthesized from CBD using acid catalysts.
### Is HHC stronger than THC?
