What is Nevada's cannabis DUI law?

Nevada Revised Statutes (NRS) 484C.110 sets a per-se DUI limit of 2 ng/mL active Δ9-THC in blood. Driving above this limit is a DUI even if you do not feel impaired. NV also has a separate inactive-metabolite (carboxy-THC) limit of 5 ng/mL. NV is one of the few US states with a per-se cannabis DUI threshold.

How long do I have to wait after smoking before driving?

Conservative wait time: 6+ hours after smoking/vaping, longer for heavy or new users. THC blood levels peak within minutes of inhalation and decline rapidly, but per-se prosecution looks at blood draw timing. Smoking 1 standard joint can keep blood THC above 2 ng/mL for 2–6 hours. There is no field-test that proves you're under the limit - wait longer than you think you need.

How long after eating an edible before driving?

Wait 8+ hours after edibles. Edibles produce slower-onset, longer-duration blood THC peaks (2–4 hour onset, 4–8 hour duration). Edibles often produce higher peak blood THC than smoking the same dose. For multi-day heavy edible users, blood THC can stay above per-se limits for days.

Will edibles show up in a roadside drug test?

NV does not currently use mandatory roadside saliva tests for THC, but officers can request blood/urine tests if they suspect impairment (smell, behavior, eyes, FST performance). Yes - edibles produce both Δ9-THC (active) and 11-hydroxy-THC and carboxy-THC (metabolite) that can register in blood/urine tests. Prior consumption of edibles can show in tests for 1–30 days depending on frequency.

What's the penalty for cannabis DUI in NV?

First offense (NRS 484C.400): up to 6 months jail, $400–$1,000 fine, 90-day license revocation, mandatory DUI school. Second offense within 7 years: up to 6 months jail, $750–$1,000 fine, 1-year revocation, mandatory ignition interlock. Third offense: Category B felony, 1–6 years prison, $2,000–$5,000 fine, 3-year revocation. Penalties stack with vehicular manslaughter or injury charges.

What if I'm a passenger with cannabis in the car?

Passengers cannot consume cannabis in a moving vehicle (NRS 484B.150 - open-container-equivalent). Cannabis must be in sealed original packaging during transport - opened packaging in a vehicle is treated similarly to an open alcohol container. Trunk storage is recommended for any opened cannabis. The driver cannot consume regardless of whether the vehicle is moving.

Can I be DUI for medical cannabis?

Yes. A medical card does not exempt you from per-se DUI prosecution. NV's 2 ng/mL active-THC limit applies to recreational and medical consumers equally. Medical-card holders facing DUI charges can present medical-need evidence at trial, but it does not reverse a per-se positive blood test.

What about CBD-only products and driving?

NV's per-se DUI law specifies active Δ9-THC. Pure CBD products with <0.3% THC (federally legal hemp) generally do not produce blood THC above per-se limits. However, full-spectrum CBD with measurable THC can produce trace THC in blood - heavy daily users have failed per-se tests on full-spectrum CBD alone. Read the COA and choose isolate or broad-spectrum if driving is a concern.

How does NV compare to neighboring states for cannabis DUI?

California: no per-se limit - must prove impairment. Oregon: no per-se limit - must prove impairment. Utah: zero-tolerance for any detectable THC (0 ng/mL) in active driving - far stricter than NV. Arizona: zero-tolerance in active blood, but reformed under Dobson v Arizona (2014) to require impairment. Idaho: zero-tolerance + state-level cannabis prohibition. NV's 2 ng/mL is in the middle.
