Short answer: THCA in Nevada is legal only inside the licensed cannabis retail system under Nevada SB 356 (2025). The federal vs Nevada split
Federal 2018 Farm Bill defines hemp as cannabis with ≤0.3% Δ9-THC by dry weight. THCA is not Δ9-THC, so by the literal text, hemp flower could contain unlimited THCA and still be "hemp" at federal law. Smoke shops nationwide built a market on this for several years.
Nevada's response: in 2024-2026, the NV CCB and the NV Department of Taxation clarified that the relevant compliance figure for unlicensed-cannabis-sale prohibition is Total THC - defined as Δ9-THC + (THCA × 0.877). This Total THC formula captures the post-decarboxylation cannabinoid load. What changed under Nevada SB 356 (2025)
The NV CCB's enforcement deadline for compliance with the Total THC standard ended under Nevada SB 356 (2025) compliance windows. Smoke shops, vape shops, and convenience retailers across Sparks and Reno pulled THCA flower, Δ8 carts, HHC carts, THCO products, and intoxicating "hemp" edibles from their shelves on or before that date. The licensed retail system - Greenleaf Wellness and other NV-CCB-licensed dispensaries - was not affected by this enforcement; it continues to sell THCA-rich flower and concentrates because those products are inside the licensed framework.

Where THCA still legally exists in Nevada
THCA inside a licensed dispensary product is legal. Specifically:

Where THCA is no longer legal in Nevada
Outside the licensed system: THCA flower marketed for smoking, THCA diamonds at smoke shops, "hemp" pre-rolls, and intoxicating-cannabinoid vape carts (Δ8, HHC, THCO) - none of these are lawful for sale in Nevada under Nevada SB 356 (2025), regardless of how they are marketed. Possession in personal quantities (within the adult-use limit of 2.5 oz of flower, or 0.25 oz / 1/4 oz of concentrate, per NRS 678D.310) is generally an enforcement priority for sellers, not buyers, but transporting these products in commerce or selling them at retail is now subject to NV CCB enforcement.
Edge cases worth knowing
CBD-dominant products with trace THCA - A CBD tincture or topical with low total cannabinoid content and trace THCA may still be legal under NV state law and the federal Farm Bill, depending on the Total THC math. The seller should provide a NV-compliant COA on request.
Out-of-state purchases - Cannabis (including THCA flower) cannot be transported across state lines under federal law (21 U.S.C. § 812 Schedule I). Buying THCA flower in Oregon and bringing it to Nevada is a federal violation regardless of either state's law.
Tribal land - Federally recognized tribes (including the Reno-Sparks Indian Colony) operate under their own regulatory frameworks.
