Hemp-loophole disposables were typically built from federally-derived CBD that was synthesized into Δ8, HHC, or THCO (or labeled as "hemp Δ9" with a low Δ9-THC dry-weight ratio in a heavy oil base). The hardware was often imported, sometimes with lead and cadmium leaching from the heating coil into the oil over time. Lab testing was not federally required at the same level as Nevada cannabis. After NV CCB enforcement on the Total THC standard (Total THC = Δ9-THC + THCA × 0.877) closed the loophole at the state level under Nevada SB 356 (2025), these pens are not lawful for sale in Nevada retail.
