Disposable THC Pens in Nevada: 2026 Compliance Guide
Short answer: in Nevada in April 2026 the only lawful retail channel for an intoxicating disposable THC pen is a NV-CCB-licensed dispensary. Disposable pens labeled "hemp THC" or sold under the federal-loophole framing (Δ8, HHC, THCO, "compliant Δ9 hemp") are no longer compliant for sale in Nevada smoke shops, vape shops, or convenience stores after the Nevada SB 356 (2025) enforcement. Disposables at a licensed Nevada dispensary like Greenleaf Wellness on Glendale Avenue are eight-panel-tested, METRC-tracked, and child-resistant.

TL;DR
Licensed disposable THC pen: Δ9-THC distillate or live resin, 0.3-1.0g pen capacity, 80-95% cannabinoid potency, full eight-panel COA, NV CCB packaging compliance, dispensary retail only. Hemp-loophole disposable pen: Δ8 / HHC / THCO / "compliant Δ9," variable testing posture, no longer lawful for Nevada retail sale under Nevada SB 356 (2025). Choose by COA, not by sticker.
What is a disposable THC pen
A disposable pen is a self-contained vape device with a battery, heating coil, cartridge of cannabinoid concentrate, and a sealed mouthpiece, all in a single unit that the user discards when the cannabinoid runs out. The form factor is convenient (no need to charge a 510-thread battery, no cartridge changeover) and is popular for travel and discreet use.
Licensed Nevada disposables typically come in three sizes:
Cannabinoid load on the pen face is usually a single percentage (e.g., "85% THC") covering Δ9 distillate or "78% live resin" for full-spectrum live concentrate.
- 0.3g - about 100 pulls
- 0.5g - about 150-180 pulls
- 1.0g - about 300-350 pulls
Licensed disposable supply chain

Hemp-loophole disposable supply chain (no longer compliant in NV)
Hemp-loophole disposables were typically built from federally-derived CBD that was synthesized into Δ8, HHC, or THCO (or labeled as "hemp Δ9" with a low Δ9-THC dry-weight ratio in a heavy oil base). The hardware was often imported, sometimes with lead and cadmium leaching from the heating coil into the oil over time. Lab testing was not federally required at the same level as Nevada cannabis. After NV CCB enforcement on the Total THC standard (Total THC = Δ9-THC + THCA × 0.877) closed the loophole at the state level under Nevada SB 356 (2025), these pens are not lawful for sale in Nevada retail. How to spot a compliant licensed disposable
Look for:
If any of those is missing, the product is not from a NV-CCB-licensed source. For the label-reading walkthrough see how to read a Nevada cannabis label.
- NV CCB universal symbol on the box or pen
- METRC tag (16-character alphanumeric)
- Lab COA QR code or printed URL
- 21+ statement and federal warning
- Lot / batch number and packaging date
- Child-resistant outer packaging
- Net concentrate weight (g)
- Cannabinoid % (Total THC, Δ9-THC, THCA)
- Terpene panel (typical for live resin disposables)
Hardware quality matters
Even within the licensed channel, disposable hardware quality varies. The good news: the NV CCB lab heavy-metals panel (Pb, Cd, As, Hg via ICP-MS) catches lead and cadmium leaching from cheap cartridge coils. Lots that fail the heavy-metals action level cannot be sold. The licensed channel does not guarantee zero hardware risk, but it guarantees that the hardware-and-oil combination has been tested.
For the heavy-metals frame see why lab testing matters cannabis vs hemp.
Storage and end-of-life
Disposables should be stored upright at room temperature (60-75°F) and out of direct sunlight; heat accelerates terpene degradation. End of life: the device contains a small lithium-ion battery and should not be thrown in household trash; many Nevada dispensaries (including Greenleaf) accept used disposables back for proper recycling.
